Terms of Service

1. Acceptance of Terms 

By placing an order with Fong Brothers Printing, Inc. (“we,” “us,” or “our”), _______________ (“Client”) agree  to be bound by these Terms of Service and Confidentiality provisions. These terms apply to all services we  provide, including printing, design, mailing, and consulting. 


2. Services Provided 

We offer a range of commercial printing services, including but not limited to: 

  • Offset and digital printing 
  • Large-format signage and banners 
  • Brochures, labels, packaging 
  • Graphic design and prepress 
  • Direct mail and fulfillment services 

All services are subject to availability, project scope, and turnaround time. 


3. Quotes, Orders, and Approval 

  • Quotes are valid for 30 days unless otherwise stated.
  • Jobs begin only upon receipt of final proof approval and full or agreed-upon payment.
  • Clients are responsible for reviewing all proofs. We are not liable for errors after approval. 


4. Payment Terms 

  • Full payment is due before production unless otherwise agreed. 
  • Accepted payment methods: credit cards, checks, ACH, and wire payment. 
  • Invoices past due by 30+ days may be subject to late fees or collections. 
  • We reserve the right to withhold delivery of materials until full payment is received. 


5. Turnaround Time & Delivery 

  • Turnaround times begin after final approval and payment. 
  • We do not guarantee exact delivery dates unless stated in writing. 
  • Delivery is available via local courier or national shipping services (e.g., UPS, FedEx, USPS).
  • We are not responsible for delays caused by third-party carriers. 


6. File Submission & Production Responsibility 

  • Clients must submit print-ready files that meet our specifications. 
  • We may assist with file preparation for an additional fee. 
  • We are not responsible for errors or subpar results due to incorrect file formats or low-resolution  images. 
  • All content must be legally owned or licensed by the client. 


7. Cancellations & Refunds 

  • Orders may only be canceled before production begins. 
  • Custom orders are non-refundable once printing has started. 
  • In the case of confirmed production errors on our part, we may offer a reprint or partial refund at our  discretion.
  •  Defect claims must be made in writing within 5 business days of delivery 


8. Confidentiality Agreement 

We recognize that clients may share proprietary or sensitive information during the course of a project.  Therefore: 

    a. Definition of Confidential Information 

        “Confidential Information” includes any artwork, designs, files, product details, mailing lists, or business data  disclosed by the Client that is not publicly             available. 

    b. Confidentiality Obligations 

        We agree to: 

            • Use Confidential Information only to complete your order. 

            • Take reasonable steps to protect confidential files and data. 

            • Limit access to only employees or contractors directly involved in production. 

            • Not disclose any confidential content to third parties without your written consent.

    c. Exclusions 

        Confidentiality does not apply to information that: 

            • Is or becomes public knowledge through no fault of ours 

            • Is disclosed legally under subpoena or regulatory obligation 

            • Was already known to us before disclosure 

    d. Term 

        Confidentiality obligations remain in effect for two (2) years from the date of disclosure or until the  information becomes public by other means. 


9. Intellectual Property 

  • All designs, content, and trademarks you provide remain your property. 
  • We may display printed samples for portfolio or promotional use unless you request otherwise in  writing. 
  • In-house designs remain our intellectual property unless transferred under a written agreement.


10. Limitation of Liability 

To the maximum extent permitted under California law: 

  • Our total liability for any claim is limited to the value of the job in question. 
  • We are not liable for indirect, incidental, or consequential damages such as lost profits, missed  deadlines, or business interruption. 


11. Governing Law & Dispute Resolution 

This agreement is governed by the laws of the State of California. 

  • Any disputes shall be resolved in the courts of San Mateo County, California. 
  • Both parties agree to seek informal resolution before pursuing litigation. 


12. Updates to Terms 

We may revise these terms periodically. The latest version will be posted on our website with a new effective  date. Continued use of our services indicates your agreement to any updated terms.
